I guess the game was just that good. We techinically didn't get evicted..YET. But we have 10 days to get out before we do get evicted.

We were warned before, but were never told why. We assumed it was from running our laundry machines to late(it says not to run past 10 becuase they are loud, and we did a few times). Apparently that was not it.

Yeah we thought it was pretty ****ty to. It was the people above us, and they just stomped on the ceiling, but we stopped playing at that point. But I guess they still complained.

Yeah, everyone around us is older, so it kind of sucks. College kids don't really fit in. We are going to talk to the landlords tomorrow, me and my roomate were just home for thanksgiving, so we had to wait untill tomorrow.

I actually didn't even notice that. We are clearing everything up tomorrow, so hopefully something at least somewhat favorable can happen. Our worst case scenerio is that we have to leave, and continue paying out our lease. Which would mean paying rent at two places, which would really suck, not to mention neither of us can afford that.

Yeah it clearly says in two places that you can leave (and still pay rent) -or- comply with the rules. You don't have to leave.

On a serious note that truly blows and I would argu...err...talk with the landlord. Just to apologize and plead one last strike. Than look for a new place with your new bought time and light that place up with rock and roll before you move out.

Yeah I just never noticed that before. I only read through it one time before I left for the weekend, and forgot to bring it home with me. There might be some hope for us afterall.

We do live on the ground floor. Either way we are going to try and find someone take over our lease if that's the case and move out. The place we want to go is essentially condos, and everyplace is seperated and shares no walls.

We will go talk to them tomorrow. Hopefully we can come to an agreement. I don't think we want to be any worse then we were before we move out. That just doesn't seem like a good idea.

According to what I read there, no one is being throw out if they are willing to abide by the rules (24 hour quite period, WTF) then they can stay, but since I assume they are going to continue to play Rockband (Who wouldn't) then I guess it's as good as an eviction (except that they will remain responsible for the rent)

What's great is I just read this as I turned my dishwasher on, and it's about 12am on the east coast right now. I was worried about getting something like this at some point, but I try to keep the noise down while playing. I think the kick pedal is the biggest culprit.
Last night I had some friends over, and we were playing until 2am. On top of that, one of them got a little too excited, and decided he wanted to become a singer, so he started jumping around while singing Enter Sandman, and some other songs, and I was pretty sure I'd be hearing something about it from someone today, but maybe I lucked out. Or maybe its because the office is closed on Sunday. Fortunately my living room is on the far side of my apartment, so the wall that is shared with my neighbor is on the other side of a bathroom and the master bedroom, so I'm not worried about them. It's the poor girl that lives below me that I'm concerned about.

I've been pretyy lucky so far with my third floor apartment.
I have no balcony (my living room extends out where the matching unit on the second floor has a balcony) so if I stomp the pedal on the drums any vibration would be over their balcony rather than their living room. Of course this place is built like a tank anyways (they claim 'condo spec') and the walls and floors seem really thick.

I can't see how they can claim they have a mandatory quiet time 24 hours a day but then limit you to when you can do things such as running the dishwasher. It either fits in with the 24 hour quiet time or it doesn't. If my dishwasher is too loud at 8 Am why is it not too loud at 9 pm since it makes the same amount of noise.

lol i live in a trailer court and my neighbors come to my door becuase they want me to turn down the rock even though theres a pretty big space between each trailor damn you need to crank the 1000 watt system all the way up

Personally, I'd set up a meeting with a lawyer that gives free consultations. From what I understand, it's pretty ridiculously difficult to evict someone (a lawyer would know better than I), and it takes months. Odds are good that you could drag out the eviction until the lease is up and then move at that time. I'd probably try to work something out with the neighbors in any case, but then, I'm too nice for my own good. ;)

dude that sucks. i'm really glad my neighbors are friends of my other room mate. there's been some nights have i've had rock band and guitar hero cranked on my system downstairs and they can't even hear it.. or they're heavy sleepers.

That notice means nothing they have to get a sheriff give you the ten day notice. That one is just to try and scare you out. I work in the Apt business. There is noting legal about that notice.

To the guy who said that paper wasn't legal. It's legal.
Also it clearly states that between 10pm and 9am your activities should not be noticed by your neighbors. You should probably read the lease agreement you signed. Make sure it says that in your lease agreement.
The 24 hour quite time is just so you don't have people cranking music and parties every hour of the day.

So basically you have 10 days to stop making noise. The way I understand that is you have 9 days where you can still be loud, but if you are quiet on the 10th day you are in compliance :D During those 9 days, get as much foam as you can and pad the hell out of the drums.
Or as someone else said, start looking for a better apartment that doesn't cater to old people. You know what they say: if it's too loud, you're too old.

That notice is perfectly legal, it's the first step in the eviction process. The next step will be an Eviction Summons served or posted by a deputy or a process server. If you move out because of that notice...you will still be liable for the remainder of the lease, and they'll want it all up front. Try to work it out, but if they are going to evict you then make them go through the whole process, it takes about 4-8 weeks depending on how fast they want to ramrod it through. But be aware that most complexes share a blacklist of evicted tenants with each other, so it may be difficult for you to find another place.
Your best bet is to quiet down late at night and finish out the lease before moving...it's going to cost you a lot of money otherwise. You could attempt talking to your neighbors and asking them to knock on your door if you're too loud, but this usually only works before there's a problem, not after. People are not inclined to knock on strange people's doors these days unless they've already met them, it's a good way to get hurt.
The posters that have a problem with a "quiet after 10" rule obviously doesn't have to get up and go to work in the morning. Don't worry, kids, the time will come when you realize you've gone from "the one the cops get called on" to "the one that calls the cops". It's also something you could get fined for in most cities.

True. They use the qualifier OR in there. Go to the office and complain that you were not warned in person. Try to get the specific hours that the complaint was registered. If the complain was registered at 9:59 or earlier, you are scott free. In the mean time, put a sleeping bag (folded) under the drumset and two pillows under your sub.
I was warned about having an inflated innertube on my balcony. I took it down for two weeks then put it back up. That was 4 months ago.

Man, I couldn't stand playing this in an apartment building. My closest neighbors are 1/4 mile away. I have mine hooked up in my basement, where I have my recording studio, and I am pushing my 360's sound through my 800 watt PA system. Overkill in true rock fashion.

I live in a house. A smaller house, but a house none the less.
There's a problem when a REAL rock band moves in next door, decides they won't pad the walls, and plays until 4 am all night every week.
Even after me going over and asking politely for them to turn amps down or something.
After two weeks of trying this, there was a very specific big, about six foot man in a particular black uniform giving them a citation for disturbing the peace.

There is actually a lot of places available suprisingly. I think there is a lot of openings becuase a lot of people are on exchange programs, and those that come back for the winter and spring term will need a place to stay.
The people upstairs actually got worse today. I was playing again with just guitar, so it was only the tv making noise. And it was no louder then normal watching tv volume. This is nothing new, as we played guitar hero all the time, but of course they started stomping again.
I could understand before, we were playing past 10, on a weeknight, and the drums could easily get annoying.
But this was at 11-12 in the afternoon. So we are obviously not keeping them awake from work or anything, and again, just having our tv on in the afternoon is nothing new. And is nothing to be complaining about.

Since you live in an apartment, turn your room into a sound-reduced room. One idea that works is well is to cover your walls with egg cartons (the kind that hold 30, not 12). You can sometimes get them from local groceries and sometimes neighbors. The cartons will reduce the noise significantly. Get them up on the ceiling too for those noisy neighbors.

I actually considered that, but if we can't even have our tv on now..I doubt that is really going to help.
My roomate will be home in a few minutes, and then we are going over to talk to the landlord. So hopefully we can leave somehow without paying rent and get a new place. Im tired of dealing with these people.

Man, that sucks. I live in an apartment building (with thin walls, might I add) and my fiance LOVES the turn the music really high. I'm waiting for the police to come knocking on our door, but so far we've heard no complaints (heck, if they can complain about our music, then we can complain about them yelling at their kids and smoking weed in the hallway). But luckily our living room is above a hallway and no one's bedroom, so I don't think the noise is a huge problem when he's banging on the drums.

Not sure if someone said this or not (it was so long, I just kinda skipped ahead). You might actually have a legal case against them. Since they didn't specify what you were doing that was causing the noise, and you made an attempt at stopping it (since you stopped using the machine's after 10) they can't kick you out. Unless they say "your game playing is too loud" or something similar, I don't think they can kick you. Also, I think you're suppose to get something like 3 warnings. It might vary from state to state, I know that was the policy in my last apartment.

We didn't get kicked out. We went and talked to the manager, and he was really cool. He siad that them stomping wasn't acceptable either. The same thing happened with me Luminary Pants. I had downstairs neighbors who would always complain but we knew they had no case against us. We were being respectful (this was way before Rock Band btw). And they kept complaining. Finally, they stopped. But I hope they don't start again with Rock Band now. Awesome about your story.

I got a unlawful noise ticket from the local cops last night. This one was for $200. Next offense is a $1400 fine...
Sometimes I wish people would just be civil and knock on the door, and politely ask to turn it down. That would be all it takes.
I'm honestly too scared to knock on our neighbors' door. They're all young guys (ok ok, only maybe 5 years younger than me) but I'm a fragile girl! They are generally drunk anytime past 8 PM, and they've trashed our condo's common areas. They have enough disposable income to continually pay fines (I think our association has fined them at least $2k). Can't evict 'em (they own). So the police it is. Luckily they're more the Halo and FPS shooter types, which tend to be less annoying. It makes me happy that I can bug the hell out of them too now! :D

I used to live in apartments but didn't have any problems with the noise because most of the families had kids. I live in a house right now so i can crank my volume up loud. I have roommate but he works during the day and I'm usually asleep by the time he comes home. I'm in the military and will be going to Georgia in a few months. I'll probably be living in an apartment not unless I can get a house with a roommate.

We're not as rare as you all think, just imagine all the places that are open at night(10pm-7am), all the services that need maintained, etc. I'm up at night on my days off, and I want to ****ing play. Yesterday me and my roommat and two other buddies got yelled at by our land lady for having our windows open and rock band playing way to loud.
"NO!!!!!!!!! This can not happen, your windows are open and the music is wayyyyyy to loud!!! I heard you guys the other day but didn't say anything but today NO!!!!!" Then she started ranting about we'll be having downstairs neighbor soon.
Right now I have no downstairs neighbor right now so all I got to worry about is the sound bleeding out of the apartment…When I do though I'll implement no drums past 9 PM after that it's just guitar action.

BAD IDEA, if anything be a very good tenet, if you play your music loud, they most likely have the right to evict you even faster, also the landlord will be told and will be a blemish on your rental history, what do I mean by that? Most apts want rental references (past landlord that will be contacted) it would not be good if you have a very hard time getting an apt just because you were a noisy neighbor. Also most noise rules in apts are in place due to noise ordinances that are in place in the town/city you live in.

i used to work nights, 4 days a week, and the rest off. And i was playing loud music when i was at home during nights... So on the first day, i walked down, knocked on my neighbours door, and explained my situation, and told them to just let me know if my music ever disturbed them.
never got any complaints... :)

I've had inconsiderate neighbors like you before, so it's good to see action being taken against people that show little to no respect for others. Think about someone other than yourself next time.
I agree;)- and to people saying "just crank it for the next 10 days"- the noise bylaw where I live would get you a $500 fine the first time the cops are called, and $1000 every time after. Bet that would really add up in 10 days:p

I'm a little worried about this happening to me since my next door neighbor is blind and you know how they say when you lose one sense the others get better, plus I'm sure pretty much everything in his house requires sound for him to use it.
Luckily we're on the first floor so the jumping around with the guitars isn't a bother, only the speakers :D

I agree with you 100%. The place I lived over the summer, the guy next door was building a shed or something, and their dog barked constantly. Granted, my sleep schedule is screwy anyway, since I sleep during the day throughout the week but am up during the day on the weekends because I have band practice and shows and stuff like that.
That said, I've been paranoid about the neighbors since I got the game on release day. I've had no complaints as of yet, nor have I heard from the landlord, so I guess I'm doing alright. I was doing a BWT by myself (bass & vocals at the same time) and had a knock on my door earlier tonight, I thought "well, guess it's time to put the game away for the night." Turned out it was just a couple of the neighbor folks asking if I had a deck of cards. Also I should add that I'm on the top floor, only one neighbor sharing a wall with me, and I'm not sure if the apartment below mine is occupied or not.

I'm having a huge fight with my landlady over the sound the rock band drums make -- not the audio from the game, just the sound hitting the pads makes.
It's really pissing me off. My landlady lives upstairs and apparently can hear the drums. She's a cranky old bioootch who can't seem to tolerate any noise or noncompliance with her rules for the apartment building.
After she initially complained, I tried to sound-proof the room and tone down the drum pad sounds by stacking various materials on top of them and underneath and stand. She's still complaining. And, all this crap on my drums makes them hard to play; if anything, I probably have to hit the pads harder than I normally would to get them to register!
I wish she'd been able to take the stance of your landlord and recognize that everybody has to put up with a little noise from time to time. But, apparently not. She's an old, fat battle axe of a woman with a lot of psychological problems. And, her cat just died. I bet that's why she's oppressing me.
Don't know how this will work out, but more than likely, I'll have to sell my beloved Rock Band kit :-( I live in San Francisco, and it's pretty much impossible to find an apartment, let alone afford one. So, sucks to be me, I guess.

I think the biggest part I don't understand is that IF you were playing in normal hours.....where do the complains come from? We have to be quite from 10 pm to 7 am......even then, we're realitively quiet until about 10-11 am. After that time? I play Rockband to my heart's content. LET them complain....because I'm quiet and respectful enough to let people have some quiet after 10:00 pm.
Sad though that the Landlords have been like that. They SHOULD have sat down and spoke to you about it before they evicted you. Granted, they don't have have to since they own the land, but that's when I wouldn't want to be living under that kind of management.
Just to be nicer to our neighbors, I'm doing the whole drumkit mod this weekend, and also going to buy a shock pad at sears. Won't be more than 40 bucks, but should help save everyone's ears and avoid complaints.

although i feel for folks having to "tone down" their rock band sessions, i dont blame the landlords or neighbors. if i was in their situation id complain too. if i was sick and trying to sleep, or watching my favorite tv show or a big game, and all i could hear has drum/kick pedal pounding and horrible vocals screaming, id be pissed too. i could probably tolerate it if it was just once in a while, but a daily dose of multiple hour sessions would probably make you want to bust down the door.

My Suggestion: Crank it to 11 for the next 10 days.
LOL, unfortainitly people should have a little courtesy and respect for their neighbors living in an appartment when you have people living on both sides of you, possibly above you and below you where you and have commen since to keep the volume level to a moderate level.
People have kids, babies, have to get sleep for work, some work night shift and sleep during the day, etc.
He's already admitted to breaking the rules and has been warned prior. You shouldn't have to be 'warned' each time what your offences are, you should have commen since not to do them in the first place. Espically when the rules are told an/or given to you in writting before hand. AKA, lease/rental agreement.

This was already mentioned in an earlier post from a night-shifter, but it bears repeating.
If you are in the situation where you feel like your neighbors should be coming to you and asking you to quiet down, there is a flip side to that coin.
You can go around to your neighbors, or drop notes on their doors letting them know that your hobby is not intended to be a disruption to them. And that if it ever gets to be too loud, they should feel free to let you know.
You'd be amazed how accepting people can be when they know you as a considerate, polite person who happens to have a loud hobby. Suddenly you have an identity that isn't just the bump, bump, bump through the walls or floor.
The OP's results are actually a decent example. When they actually talked to the Landlord, he was fair and accomodating. Had they just rokked for 9 days (while fun, and a great story later in life) it would have been expensive in more ways than one.
