so what's the deal with band names?

I finally thought of an awesome band name I would actually use, but no suprise there is already a band by the name on myspace. I've seen different bands with the same name on there before, and once before I had a band that kept being mistaken for a band of the same name from england. But is it legal to name your band the same as an already existing band? Do they have to copywrite the name or be signed? Anyway it is a cool band name I thought of, but aside from the band there is a website with the name already. Gonna see if it's taken on rockband anyway hehe.

I believe it depends on the country of origin. For instance, there are 7 different bands listed under the name "Ethereal", but they all come from different countries.

That's one of the problems with rock music these days, is almost every name possible has been used. That's why you have bands with ridiculous names nowadays.
