ok, so i've been using my drums for a couple days now and, out of nowhere the pads started registering as the pad and kick pedal. Then, while i was on the setlist, the kick petal register a whole lot of times sending the curser everywhere on the setlist and when i finally got to a song to play, the pedal didnt register at all when i hit it, but register when i hit the yellow pad
WHAT SHOULD I DO?!?

How long have you had them? If it's under 60 days and you still have the receipt, I suggest you RMA (http://customersupport.ea.com/loginapp/rockband/rockband_portal.html) them.

i got them a few days ago, but should i request for the pedal or pads because to me it seems like both

Pads only. You can test the pedal with another set (preferably a RB1 set) to be sure, but this is nearly always an issue with only the pads.

From what I've seen in the forums, this is usually an issue with the kit itself. There's probably something faulty in the sensors, not in the pedal.

Because our Limited 60-day Hardware Warranty requires that you are within the first 60 days after purchase, we will need a legible copy of your original sales receipt to determine eligibility.
I'm afraid so. You'll end up having to buy a new kit if you don't find it.
