This was in reply to the "Drum Hero is AWESOME" thread. but they closed it. so here goes, he was saying that HMX and EA should be ashamed of sending out defective products and ended the post with "CAN YOU SAY CLASS ACTION"?

so here is my reply..

yeah, I dont think HMX is too blame all that much. I think what probably happened, is that they found the problems, and wanted to fix them...

But EA probably pushed them to fix as much as they could, but probably wouldnt allow them to delay it past that great holiday time release.

Its sad, But I really think, based on what i've heard about HMX admitting they found problems? most of the actual developers dont enjoy sending out any game thats not as good as it could be. yet every month there are at least a couple games that are released with major bugs or defective discs, etc. Its because the publishers want the game on the market, and they want it on the market at the right time. because a febuary release is probably going to make alot less money.

and with a game like rockband, being so expensive as it is. would def not gain as much profit as it would with a christmas release any other time of the year because alot of parents dont like to spend so much at once, during the year, but at christmas time people seem to just buy alot more for their kids. so a christmas release really helps sales of large items.

If some idiot wants to waste money on a lawsuit, let them. By the time it is over EA will have repossessed their house to pay the EA lawyers' fees.

Were some of the products defective?

Yes.

Has EA attempted to remedy the situation?

Yes.

Has anyone suffered provable monetary, physical, or mental harm because of this product?

No.

Case dismissed. Plaintiff to pay court costs and all legal fees incurred by the defendant, in the amount of eleventy-trajillion dollars.
