What do you need to do or not do to have Rock Band / Guitar Hero videos legally posted on Youtube? Or at least legally enough that they don't get deleted and accounts don't get suspended? Just stay below the radar? Simply a matter of what songs they are? Or is there some combination of factors that causes WMG and other copyright holders to go into attack mode that needs to be avoided?
I'd always wanted to do some of my own and I'm just now starting to get good enough where I can actually FC some songs on expert. Not sure what to make of the situation now, though, the frenzied crackdown seems to have died down to some extent but while some people are apparently getting away with it now others are still having their videos deleted.

Technically your version of the song must sound different than the actual song. WMG throws around warnings all the time, but since your videos sound different, they have no legal right. Doesn't mean they won't take it down though.

What? They absolutely do have all legal rights to do whatever they want...
Even if you filmed yourself singing into a hair comb, action can still be taken against you. The songs in Rock Band are the actual songs provided by the label... it doesn't matter if there's a virtual crowd singing in the background, or that there's any drum fills... it doesn't void the fact that it's still copyrighted material.

I believe what one guy does when he does a video capture of his rock band playing is that he has people send him messages over XBL so it makes the notification noises during gameplay.

What are we meant to be looking for here? I'm not going through an hours worth of this guy just for a simple sentence. I don't mean to sound insensitive, it's just that the guy who does these videos tends to ramble on about other topics for half the video before actually coming to the conclusion.

Pretty anything that will get you views is not allowed to be on youtube unless you pay money for rights or promotion.

What cena says what he remembers the copyright law to be... is that it has to be the 100% exact same as the original song. But he argues that videos done as drums shouldn't be removed because the drum fills are all freeform for the player and not part of the original song.
Not sure how valid that argument is or if youtube would honor such technicality.
But wasn't there something like if you're sharing files or using song clips, they're only supposed to be at most 30 seconds long?

I saw that part... I don't think Cena understands the copyright laws, otherwise he's reading the totally wrong part. It doesn't matter if there's a decibel of static, or if it's the exact same recording, copyright is copyright and the label owns the song, no matter if you sing it at home to your family or if some cover band plays it down the pub.
Fact is, YouTube is a commercial medium that allows anyone from the public to gain recognition about absolutely nothing entertaining or important, i.e., Fred. Once you start broadcasting yourself playing Rock Band or Guitar Hero, you're not adhering to the copyright laws put in place by YouTube and your own country's legal system. I'm sure each nation has their own view on the agenda, but in the end, they all turn out the same.
It's technically illegal.

This is S1ck's method for not getting his RB videos pulled down. He also disputes any attempted take downs. So far it seems to be working.

For private playback and use, not commercial playback and use.
There's a revenue program in YouTube... if you're making money off of HMX, the artist, and the music label's work, that's pretty unfair and illegal.

well, state your position that you were not trying to infringe rights and claim it was for educational purposes, many rock band videos are being ruined but if you do as i say, it might help. the videos get ruined and nobody can tell if the DLC is any good or not, for example http://www.youtube.com/watch?v=AUsH699nVxw
there exist 3rd party video sites that are less popular that you can search for DLC songs in action as the first amendment intended it to be
