I have heard a lot about the update, but when is it really coming. It has passed the 8th and it should be here. I am having a party and would like a bass.

Yeah I wouldn't expect much luck in time for that party if I were you.

A lot of guys were posting about having friends over and all that this weekend, and I think they've all come away disappointed.

Activision are a ***** like that.

lol, i just had a party this last weekend, and had a second guitar for the bass.
It worked cause i have a fualty guitar (has double strumming issues). Though my guitar is broken, it doen't break the game, and as a bass, upstrumming only, it works great.

So as luck would have it, my replacement showed up on Thursday, and i dont plan on sending it back till prolly next week so i can get two parties out of it :P

yup, figures my pedal snapped right before freakin holiday break. everyone comin home from school, tons of pregaming with rockband to do before the bars... all taken away by a 2mm thick piece of black plastic... SOB

You keep saying that. You're like a one trick pony. Ooh, catchy phrase, entitlement whore. Well, guess what, while I enjoy the game, and have said many a fine thing about it, their advertising was deceptive/false. There really is no way around it. With rumors swirling that legal action has been taken, my game will likely not work as advertised. They put, on the box, "works with most music game controllers." Now, sure, this does not refer to the Les Paul. This is, however, different from works with "most usb micropohones." Which, for the PS3, is the TRUE statement. Legally, it would be pretty simple to sue them and win, however the act would be in vain as it would likely cost more to handle the suit than would be won. To qualify as deceptive, the advertising must use "deception in advertising, in order to gain a commercial advantage." You see, in the United States, the only country the game has been released in, legally something is considered deceptive "when consumers see the advertising to be stating to them, explicitly or implicitly, a claim that they may not realize is false and material." You see, in this case, we have two implicit, unrealized claims.

The first implicit claim is that the game works with most other music game controllers. The game requires three different types of controllers. One is original and unique, thus most reasonable people would see that this controller, the drums, is not supported by the statement. However, the encompassing nature of the statement (controllers instead of microphones), implies that it would be true for guitars as well, which are commercially available outside of Rock Band. Thus, with only the guitar controller found in the box to function, this is a deceptive statement. Given the nature of the advertising on the box, this could even be considered to be an explicit deception.

The second implicit deception is their handling of the media. It is reasonable to assume that Harmonix and EA knew of the articles on major video game news sites, claiming compatibility with the Guitar Hero 3 controller on all platforms. Now, the company's lack of a statement refuting this, is an implicit agreement to this fact. However, if the product shipped without this feature, and it had to be patched in later after "getting it working," they knew prior to release that this was untrue.

As you can see, the legal arguments are fairly well based and in the hands of a capable lawyer would lead to a win. However, the cost of trying the case would far exceed the amount awarded. I do have a sense of "entitlement," however it seems that you think that sense is falsely based. My sense of entitlement actually comes from what the law entitles me to, what business ethics entitle me too, and what common decency entitles me to. I understand that you love this game, I do as well. However, the on box advertising is a deceptive act.

You can label me as a whore until you are blue in the face. Unsurprisingly, no moderator on this site is likely to do anything about it as they see my position as an affront to their organization. I simply think that you believe that everybody on my side of the argument is being overly reactionary and not thinking before they speak. I hope that this lengthy post might convince you that there is much thought, logic, and knowledge of US law going into my posts. I haven't made a lengthy and detailed post like this before, because I am lazy.

When you do bring that law suit, remember that defense lawyers will have a field day with the word "most" which is intentionally ambiguous and vague. If someone wants to ASSUME certain conclusions... well that's their perogative, but it's just that... an assumption.

What is interesting to note is that when you take into account the number of music controllers that work on the PS3, I think Harmonix was correct to put "most" on the box.

There is only one drum kit, and it works.

There are only two guitars (bear in mind that to my knowledge the PS2 controllers don't work properly on the PS3, even for Guitar Hero) and one of those works.

There are any number of mics from games like Singstar and Karaoke Revolution that work, plus the one that comes with Rock Band. So if we were only to count those three, that's still three out of three.

So five music controllers out of six (plus all of the other USB mics on the market) working justifies the word "most."

As for "handling the media," have you ever spent time working as a journalist? Apparently not, because if you had, you'd know that no one "handles" you. Companies may provide you with some facts, but they by no means "handle" what you do or don't say. That's the beauty of free speach, you're free to say what you want. Harmonix has no more control over what Joystiq, Kotaku and IGN say than I do over what is said on Good Morning America.

If you wanted Harmonix to come forth and tell you that their game will/won't work with a competitor's product, then I'm sorry they disappointed, but it's really unsurprising. You have to understand that they have to walk a very fine line with everything that they say publicly. Discussing a competitor's product is generally something that's considered a faux pas.

As for the state of this thread, there have been countless ones made with the same purpose, and they all end the same way. People get angry and start in with the trash talking of other members who disagree with their views, and the thread gets derailed. Just keep an eye on the Announcements forum, HMXSean will let everyone know when there is an update. These threads aren't producing any constructive conversations.
