I was playing The Who on the hard difficulty and I busted my kick pedal for my drums, I am wondering if I "qualify" for the warranty. Here are some pics of the damage.

I see no reason why you wouldn't be. I'd RMA it.

Return Merchandise Authorization (http://en.wikipedia.org/wiki/Return_merchandise_authorization)
Basically, call EA or use their support form to get a replacement.

I called them, I guess anything that happens to the peripherals after you open the box isn't covered by the warranty, which I am okay with. The guy was really nice and helpful, he told me that possibly in a couple of months the RB Store will allow you to buy new peripherals, or replacement parts. I think I can wait until then to get my new pedal. And if I can't wait, I have some duct tape and crazy glue, that ought to do the trick ;)

Whoa whoa whoa! Seriously? There are dozens of people on here that have gotten replacement pedals because they have broke in the exact same spot. I'd call again or visit this website if you can.

That is completely incorrect. Easily hundreds of people here have gotten replacements for gear that broke after they opened it and had been playing for a bit.

oh weak!! I just glued it up 5 minutes ago and put some rubber tape on it, do you think they'll take it after I already glued and wrapped it?

yea they will take it with glue and tape on it and it will for sure be replaced. I had the same problem and they shipped me a new pedal. (it took forever though)

nice! thanks!! How long did it take? I don't mind waiting a month or so. When my bro got his XB360 replaced, it only took two weeks.

It took us 5 days to get a new drum pedal.
Ours cracked just where yours did.
Your heel is too high up on the pedal :D
The new ones are much sturdier though.
