I had the same problem that you have, when you don't press the strum bar enought the contacts don't touch so it doesn't register. I think you can get a replacement guitar if you can have the patience to wait for it. But you can also fix it yourself, that's what I did cause I live in south america and shipping costs where going to kill me lol, in case you decide to fix it yourself, remember this will void your warranty, all you need to do is open the guitar and place a small piece of paper behind the contact on both sides of the strum bar so the metal plates get as close as posible.

If you get them close enought any little touch of the strum bar will register and at least that's the way a like mine to work, just like a reall guitar, let me know how it goes.

what you need

masking tape (and something to cut it)
screw driver
tooth pick

when you open the guitar and look at the downstrum you will notice that the microswitch is bent out on the downstrum. if you look at the up strum you will notice a gap behind the contact that isnt soppost to move. this gap was on your down strum as well untill enough down strums bent it so that it was touching the pad. here is how to fix it.

Cut the masking tape to about the size of the pad. Then take the tooth pick and gently push the bent contact forward and slide the masking tape (sticky side toward the pad) behind the contact. Put about 3-4 peices behind the contact and then repeat with the up strum.

small pad
---------------] this contact is being bent because of the pad being too small.
---------------] this contact is fine leave it alone.
____Strum bar___

This should fix your strum problems and is a simple and easy fix.
