Theory on Activision's ability to block Harmonix's Patch

Harmonix got ahold of some proprietary code, that was allowing them to reverse engineer the guitar for compatibility.

Otherwise, I can see what legal precidence there is.

This patch should be "leaked" and a way to manually put it in (via jumpdrive or inps3 browser) to get and download.... but that's just me. :)

I guess that depends on whether you believe the whispers that Red Octane cooperated with HMX while the patch was developed.
