I found this activision statement on http://www.destructoid.com/the-battle-rages-on-activision-speaks-out-about-ps3-rock-band-patch-59448.phtml#comments:

To Music Gaming Fans:

The recent announcement by MTV Games/Viacom’s Harmonix division that Activision is blocking Sony from releasing a patch and their plea to enable Rock Band software to work with Guitar Hero hardware paints a very misleading picture.

In fact, Harmonix and its parent company MTV Games/Viacom recently declined Activision’s offer to reach an agreement that would allow the use of Guitar Hero guitar controllers with Rock Band. We have been and remain open to discussions with Harmonix and MTV Games/Viacom about the use of our technology in Rock Band. Unfortunately for Rock Band users, in this case Harmonix and MTV Games/Viacom are unwilling to discuss an agreement with Activision.

Activision’s top priority is to provide consumers with a seamless marriage of best-in-class hardware and software. We are focusing our efforts on innovating hardware and software that are designed to work together, work flawlessly and provide an enjoyable gaming experience.

Best regards,

Activision

I personally think that activision is talking total crap. i believe HMX in what they said behind the patch (how activision is being selfish and wont release it)... Who's telling the truth? Activision? or HMX?

Simple answer:

Activison wants money, or something else, for their guitars to be usable on Rock Band.

Exactly. They're using the situation as extortion. They know that when it all could get sorted out in court it would be a costly enterprise, and they're hoping for a quick pay-off.

There's NOWHERE that says you can only use the GH guitars in GH. They authorize 3rd parties to use the same tech without lawsuit. The suit would be baseless, but Activision could make it a long and costly process.

Yeah, there was another thread on this the other day.

In short:
Harmonix has had the patch since December 4th and wants to release it for free.
Activision said "Wait. We want to reach a financial 'agreement'."
The patch will go nowhere until either Harmonix pays to use their own patch, or Activision relents and lets the patch go for free.

Activision obviously wants money to "allow" Harmonix to patch their own game to work with their controller. Where I come from, we call that extortion. I don't give a rat's ass if they're legally in the right. They're being absolute douchebags and screwing their own customers, as well as Harmonix's (many of which are one and the same). It's a ****ty thing to do and I for one am done with the GH franchise. Rock Band has slain it as far as I'm concerned. I don't know about you, but I'm siding with the company that has consistently, and continues to, actually care about their customers by going out of their way to allow other company's peripherals to work on their game.

Except on every retail box.

I think the whole situation stinks. 360 users are doing just fine....

With the false advertising... can we get a free 2nd guitar?

If I may point you to an already existing thread that has many replies already: Activision Replies (http://community.rockband.com/vbforum/showthread.php?t=15791)

Except on every retail box.

I think the poster meant that it doesn't state that you cannot use a Guitar Hero guitar with any software other than Guitar Hero.

Except on every retail box.

There is no such warning on ANY Guitar Hero box except GH3.

That, and even though Activision wrote it in their box, it holds NO legal weight. They could have written that you can only strum it with your taint, and it doesn't mean you have to.
You can't mandate how you use hardware AT ALL.

At this point I just want the damn patch out and I don't care what it takes. What does everyone think of boycotting ALL DLC for RB and GHIII until this is settled?

I've purchased everything but the Police pack for RB and I'm seriously considering not buying anymore until this is resolved.

Put the screws to both companies. The only language both understand is $$$$$
