This band is desperate and willing to be in Rock Band!
They posted on their Myspace asking people to request them for Guitar Hero 5! (http://tinyurl.com/y9oypv5)
And here is a Quote for their message boards from lead guitarist, Carl Bell on his interests in having their songs in RB/GH:
I've played both Guitar Hero and Rockband. Would be completely fine of course being on either one. We've had a few songs in vid games already, would be fine with more.
Please send them a message or reply to their blog post showing your support and letting them know about RBN. I know if enough of us reach out to them, we are bound to finally get Fuel in Rock Band. Requesting them for GH is a lost cause. Please help me out here guys!

They should still have rights to their stuff from ten years ago despite the departure of their singer from then. If I remember correctly, the drummer actually wrote the songs.
"Shimmer" would be an instant download for me.

Actually, their guitarist, Carl Bell, has written all of their music and he is one of the 2 remaining members. So he should still have all of the rights.

I'm not sure I'm following here -- if they're "desperate and willing to be in Rock Band" then why do lots of people need to contact them? They definitely know of the game, want the exposure and are willing to submit for it. Why deluge them with requests, then?

They need to know that we want and support them in the game and we need to make sure that they know that it is possible for them to put their own songs in the game and not have to wait to be contacted by Harmonix (cause that is what it seems like they are waiting for). Trust me, if they know that the Rock Band fanbase wants them and they know how they can get their music in the game, they will reach out. I've had the pleasure of meeting the band before, and they very much appreciate their fanbase and try their best to help out.

Come on, it's still a good song. Sure, they have better songs that don't get as much attention, but that doesn't mean that it's a bad song. Sort of like SLTS with Nirvana. I find most people just hate it because it's a popular song. That's kind of annoying...

I think they might have wanted us to pester HMX or Activision to get their songs in the games.
Of course with RBN they can do it themselves, so you can tell them about that I guess ;)

Correction: Their label, Sony, owns the rights. Contacting Fuel won't do you any good. It's Sony who would have to sign the paperwork for this to happen.

*sigh* I guess it's still good for them to know about it. They are waiting on us to contact Harmonix to contact them/their label, while it would be much easier just to contact them, and they could go to their label.

the record company has all the rights. band members or not, not important.
