Green Day and possibly Rock Band 2 will also be $10. But, Lego was also $10 cheaper, new, than the other titles at retail price.

I dont want to buy the game but for $10 I would like the songs. I couldnt find this on the PSN. Is it there or would I HAVE to buy the game AND pay $10 to export these songs?

Yes you have to buy the game and pay the export code.
The game is $29.99 brand new now. If you have a problem paying $40 for 45 songs you are in the wrong hobby ;)

Yeah, you need to buy the game new to get the code so you can pay the $10 for the download.
You can then sell the game used, so even if it costs you $30 for the new game, you can get ~$10 back in trade in credit.
Try it though, it's a lot of fun. There are some fun gameplay options in it.
