Broken drum pedal

Sorry, I know there are allot of threads about this but I couldn't get a straight answer. My pedal is broken at the base, like others I don't feel like I really abused it.

My question is, when I go to the replacement page it says "We cannot accept returns of certain items that have any evidence of abuse beyond the normal usage." should I just ignore that and request a new one?:confused:

Again, sorry for such a dumb question.
