new rockband won't update

I just bought rock band and when I put in my disc it says
"the latest update data for this game has been found
to sign in and play you must update the game to the latest version"
version 1.03

so i click ok well it says downloading update data do not turn off system
but it will not go past 3% then it gives me an error message
it signs me out an error accurred during the download operation (80710723)
Is it a bad disc??

I tried downloading it a couple of times it worked on its on I didnt have to open the port
