There is no new update. When you play alot of games that have updates, your cache clears the older ones. Basically you are just reinstalling an older update.
This is for 360 btw. Not sure if ps3 works this way.

Ever since the patch release a few weeks ago I have to update Rock Band almost every day I start it up. I have no idea why.

The new update is version 2.3. All it really does is update the Playstation Network store. It's pretty cool. The pictures, as of now, take an extremely long time to load. I hope they fix this. It's much more user friendly now.

Your cache may be too full to hold the update and for some reason isn't clearing itself out.
They have a way to clear your cache but I don't remember how off the top of my head.

He's talking about a rock band update, not the massive ps3 update that went on for two weeks.

So what do I need to update or not because if i do i can kick my brother of the PS3 right now and update and if it doesn't then I'd be pissing him of for no reason.

There is no new rock band update(unless they snuck one in without saying anything).
edit: Just checked, no update. /edit
Did you get the ps3 update yesterday? If yes then you are good. If no then a big update for the ps3(not rock band) is waiting for you.

The most important part of clearing the cache is knowing what to expect. All downloaded game updates will be removed. So if you have downloaded an auto-update for a game, in order to play it on Xbox Live you will need to re-download it.
User game saves, profiles, demos, videos, etc. are not deleted during the process.
To clear the cache on the Xbox 360 do the following:
Go to the Xbox Dashboard, select the System Blade, and select Memory.
Highlight the HD symbol and press Y.
Press X, X, Left Bumper, Right Bumper, X, X.
You will see a confirmation message to confirm system maintenance, proceed.

sooooooo on the xbox360 you use a cheat code to clear the cache... why don't they just make a option that says "Clear Cache" and be done?

Not really a "cheat code", but I definitely know what you mean. Weird.
Edit:
I think they even have another way, but I would have to search for that one too. I believe it is even stranger than this one.

We asked Microsoft about this feature, what exactly the button combination does and what purpose it serves -- here's what they told us: "The HDD cache clearing feature is a part of the Xbox 360 technical support process and is only supported in those instances. While the cache clearing operation will not harm or render your console inoperable, it should only be used when instructed by the Microsoft customer support staff. As always, any gamers experiencing issues with their console should contact 800-4-MYXBOX instead of attempting to troubleshoot on their own via this feature."
So yeah, don't clear your cache unless MS says so.:p
