My pedal isnt workn and disc

I just bought this game like 2 days ago. From day one the bass pedal works like maybe 5% of the time i want it to. I dont know what to do. i also am having problems with my disc. I get to the main menu everthing is going fine. When ever i try to actually play the game it says disc is unreadable how does this affect the warranty. By the way my system is a 360
