Am I eligible for a new drum set?

I got rockband in janurary and i've slowly been getting better at drums, im now at expert and i've come to realize that my drums arent as responsive as i once thought, and the harder drum rolls, (train kept a rollin, dont fear the reaper) are barely responding at all. also, several months back my foot pedal broke but i've kept it working thanks to duck tape =)

am i able to get a new set? or at least a new foot pedal? thanks in advance

EA has started enforcing the 60 day warranty period, so you will not be able to get a free replacement.
