Am I entitled to a new set of drums if the drums miss notes sometimes even when I hit them square in the head? Or do they have to just completely not work?

Many times that happens when your calibration is off. You can test this by going into a "Freeform" section in practice mode (like the first section of Wont' Get Fooled Again) and see if it actually misses hits there. If it does, then yes you can warranty them.

Technically, there's no rule that says your drums have to be broken to RMA them. You can specify whatever ailment you want in the warranty form and return perfectly good drums.
