I wonder how long we will be able to get replacement instruments though the website if ours break. Obviously they'll do out-of-box stuff, but will they cover for months after that? Years? I know you can get a year warranty at Gamestop for only 3 dollars (kind of a loophole since it's technically a software SKU not a hardware SKU). I'll probably do that just in case, because I've noticed on the forums and for myself that the Strat strum bars wear out really fast if you push down too hard. I know i won't damage mine with my play style but the last thing i need is to come home to a broken controller after my friends/roommates have been playing. I am hesitant about the Gamestop warranty because they may decide to not honor the technicality (like how the memo in the box says stores won't do returns), but I also don't want to be SOL if the online replacement are only good for a month or less.

I work at EBGames. I posted this a while back so Ill just re-use it.

I'm not exactly sure how this going to work. Since its a bundle and there isn't seperate SKUs it would be hard to buy a warranty. Say you warrant the whole bundle and just the guitar breaks. If you go to replace it, we'd have to take all of your accessories so we could balance out the system. We cant take a guitar from a brand new bundle becuase that would render it unsellable. What it comes down to is when you pick up your bundle, ask the manager on duty if it is ok to buy one. It's up to him.

Check out your local laws.

Maine law provides automatic warranty protection in addition to any “express” written or verbal warranty (guarantee) you received from the seller or manufacturer

All new and used goods purchased for family, household or personal use are warranted by law to be fit for the ordinary purpose for which such goods are used. They cannot be seriously defective. This warranty is known as the implied warranty of merchantability.

No matter what the length of any express warranty you received from the seller or manufacturer, you will have the U.C.C. implied warranty of merchantability for up to four years after purchase.

If your implied warranties were breached, both the seller and manufacturer are responsible for any incidental and consequential damages (e.g., they should provide you with free repair or replacement)

So..IF there is a problem....

No store can make me send it to EA for repair.
Their 90 day (or whatever it is) warranty means nothing.
I'm covered without the extra $$ the stores look for.

As far as I know, in most states the UCC allows a seller/merchant to disclaim an implied warranty, and that ruins the whole thing. I'm sure if you dig through the instructions that come with the controller, there will be something along the lines of a disclaimer, and I'm sure most retail stores have similar lines written somewhere (on the receipt, in the customer service area, etc).

Although if its defective right out of the box, then that would still be covered, unless they told you it was broken before you bought it.

In your case (MaineDrummer), you appear to somewhat luck out, because Maine is one of those few states that don't allow disclaimers of the implied warranty (except if you're a car dealer), though its unclear how long they require the warranty to last.

Even so, implied warranties don't include problems caused by abuse, misuse, or ordinary wear. So anything after the 90 days, or whatever the warranty HMX is providing, means you're likely SOL.

Well, if someone if really worried about it, buy it at Costco. I'm pretty sure they lifetime warranty anything they sell.

Or if you're buying it with a credit card, check to see if you have one that offers extended warranties on things you purchase with the card.

If you get it from Best Buy, you can buy their Product Replacement Plan for 2 or 3 years. If anything breaks, you bring it back to them and they replace the entire bundle and give you a new one or store credit if you wanted. I bought the Replacement Plan with Guitar Hero 2. My strum bar broke. I returned just the guitar and got a brand new bundle where I sold the extra game for $37 at EBGames. I really don't like dealing with the manufacturer's with stuff like this. They can take up to 6 weeks and you have to pay for shipping.

I just hope that there is a way to get a longer warranty, cause I'm sure i'll beat the drums to death and need new ones. and I hope they are fast about replacements.
