Sounds like references to Welcome To The Jungle and Slash, maybe Morello and RATM. Nonetheless there were at least two cases where GH3 prevented Rock Band from scoring a liscence.

to tell you the truth i'm suprised Metallica didn't do the same thing to GH3, but I guess Metallica wants money to much to turn GH3 down.

Had to be Slash... I thought the same thing. Oh well.

"So fans of both 'Guitar Hero' and 'Rock Band' should be pleased at the non-exclusivity of songs, especially with all the downloadable content on the way, where it's certain that they?ll be even more overlap. "
I really hope that this means that down the road the songs might become DLC on Rock Band or my GnR dreams are going to be ruined...

I had feared this was the case for some time. There are just too many similarities between the two games for heads not to butt on some matters. This is probably the best answer anyone will see on Welcome To The Jungle and that leaked promotional video.

but the question is, down the line, will these songs become available?

based on everything I've read, Slash has absolutely no say over what happens with the GN'R catalog.

Doesn't Axl own the GnR rights? So I don't see how Slash being in GH 3 would have anything to do with it. I haven't checked in a while but last I did they weren't on the best terms. Velvet Relover or RATM songs I could see being left out cause of that but not GnR.

Yeah but at the same time that's not to say Axl didn't sign an exclusive deal with GH3 for using WttJ as the encore for the Slash battle or something. We already knew they wanted WttJ so this is the most glaring reason for it's absence, at least in the On-Disc Main List.

Slash and GnR are the main feature bands of Guitar Hero III so I guess for Activision it wouldn't be right to have its feature songs on Rock Band at the same time. Activision most likely paid more money to both Axel and Slash to be their excluse at launch. However, they probably agreed in having them as a DLC for RockBand so that anybody who initially bought Rock Band III, got something that Rock Band didn't have. I'm happy now to read that we will be having the GnR songs as DLC on Rock Band..!!
By the way I pre-ordered my copy at GameStop today.

I'm not surprised by this. It makes sense that Activision would have wanted a blockbuster like WTTJ to be a GH3 exclusive and then go crazy marketing Slash with it. Activision must have wanted "not being in Rock Band" put in as part of that deal. How curious that the Rock Band WTTJ promotional video leaked all over the Internet. From the frustration that likely followed after licensing the song was impossible, it almost seems like it could have been an intentional leak.
I'd love to know if Rock Band's DLC was any part of that exclusive licensing agreement between GnR music and GH3. Maybe only the retail disc was off-limits and announcing GnR DLC content would need to be embargoed until a certain date (to ensure maximum initial GH3 sales). If it does turn up as DLC, I'd love to play the Harmonix note chart of WTTJ as I didn't find GH3's very fun to play.
Also, you have to wonder if any songs were exclusive to Rock Band in this process that GH3 couldn't get. But then again, Brosius said that the whole exclusivity thing doesn't really happen anymore and that's how they want it.
I think it's a shame that Activision went with the whole exclusivity approach. It may have been a necessary move to ensure some GH3 sales, but I don't like the whole idea of it. What if Activision gets to licensing Led Zeppelin first and puts in exclusivity as part of the agreement or something? That would suck. I hate the whole idea of it all for any music to be intentionally blocked from a competitor's game. People shouldn't be buying a game over the competition's game just for one or two exclusive songs. If your game isn't good enough without the exclusive songs, then strive to make the game good enough so that people will want it over the competition without needing to resort to backhanded licensing tactics.

Well said, we all saw the repercussions of Madden's exclusive NFL deal and the loss of 2K. Exclusivity is bad.

the rock band welcome to the jungle chart was superior from what i saw to the gh3 one. not to mention gh3 is a broken game. it's annoying. i really hope for some gnr dlc
