With the potential space for hundreds of songs, the upcoming game really should focus al least half of the songs on smaller indie groups. First off, most will gladly give you rights for very little cost just to be better known, and of course, there's the issue of masters and such. Most would also gladly give you a master or do a quick session in-house for you of the parts you need.
But the biggest reason is to thumb your nose at the big companies. They want silly fees and are in general a pain to deal with. There are a lot of good small bands out there that quite honestly blow the doors off of most of the mainstream bands. Take a group that made it into the first Guitar Hero game, The Bags. They don't tour. They are just a small band out of the East Coast. But the sound of their latest CD which just came out a few weeks ago is fantastic. Big, solid, aggressive rock. Like a big sack full of flaming gravel being drug across the frozen tundra.
Let the other games do the 60s and 70s bands. It's old, over-hyped stuff for the most part.
