I was thinking about dropping the 400 MS points for the RB1 transfer, but I have a problem. My disc is cracked from the middle ring to maybe the middle of the disc, It frequently gets dirty disc errors. My question is if I drop the 400 points and the transfer fails somehow, will I be able to rent a disc and do the transfer without paying another 400 points?

Yes, you will. The discs are all mass produced and there is no way for the console to distinguish one copy from another.
