"Lexington (Joey Pea-Pot With A Monkey Face)" failed out of PR last month and a new version has not shown up yet.

As for the Underoath song, we don't know that HMX scooped up the RBN version. Could be that the song was being work on by HMX too and no one realized it (since the same people who do dlc aren't the same that monitor/run RBN). No one knows for sure though.

If the song WAS being done by Harmonix, I doubt the label would say, "Sure, you can put this up on RBN."

Assuming whoever was responsible for licensing 1) was a single person and 2) was aware that both sides were talking about the same game. Depending on how you phrase your inquiry they might not connect the dots. (I had one client ask if we were able to make custom avatars "like they did for Nirvana". Had to tell them, wrong game. They thought we were making Guitar Hero content.)

The amount of mis-communication (or lack thereof) inside any company can be insane. Not saying that was the case here but it is a possibility.

The fact that the song was still in Peer Review when the DLC announcement was made makes me think it wasn't known about on both sides.
