I hate myself for my stupidity/help please

So Today I went to buy Lego rock band, and having not seen any new copies I decided to not bother the busy clerk and buy a used copy not thinking twice about it. Only now did it just occur to me that I don't have the code to export the songs to rock band 2. I just wanted to know if there's anyway I would be able to export the songs using a pre owned copy of the game

Nope, one time use code. You should be able to get a new copy pretty cheap though (You may have to go searching though, shouldn't be too hard). The game is actually pretty fun too. Lots of easy achievements/trophies.

It's the exact same as RB2 except with a different failing mechanic, so I don't think gameplay matters, no.

If the gameplay matters, you export and have the same exact gameplay on your platform. If you're still playing LEGO, it's either to feel warm fuzzies about your crappy 'album' or Achievements.

There are some export codes being sold on ebay, but I think your best bet if you really want to export LEGO to RB, is go buy a new copy and sell your used one back.
