As for specifics, we're not able to comment on what issues may be present with certain bands, as I'm sure you can imagine that labels / management / bands wouldn't be too thrilled if they were to found out that we were airing their dirty laundry in public. But it is safe to say that bands involved in more public drama, be it break ups, line up changes, notorious falling outs, label jumping, legal battles, etc. are going to pose more licensing challenges than bands that are together, happy and committed to one label.
Right, I can imagine bands and labels would not like their dirty laundry out in the open for the world to see.

Keeping it as general as possible (not mentioning a specific band), is it possible to get access to bands that had their own game?

I would imagine that bands that had the "own game" treatment might either be under a longer exclusive contract or might just demand an extra premium ("<insert game company> gave us our own game, we need equal treatment or more money to license to you guys")

Why not buy an xbox that can be used for RBN only content? Keeps it away from the dev kit issues and then you can buy the content from the store like everyone else The only problem would then be deciding which songs to buy, so perhaps do a competition of favorite RBN tracks from the highest selling on 360/PS3/Wii(maybe?) using forum polls like we had in TB:RB forum.

We have retail kits in house, but they are generally being used by testers. It's not an insurmountable problem and we can work around it. I believe the retail kits we use for testing are fully loaded with all the RBN DLC, and if they aren't, it's just a budget issue getting approval to purchase what we need. Again, not insurmountable and I'm sure we can make it work.

You have my official permission to play Cheesy Pop Song as many times as you want. Space too, for that matter.

Evidently someone is down.....Make it as much an educational(fun) tool as it is a incredibly fun addicting game and chances might be higher for getting some hard-to-get bands. We all know it's all about the money, but why not do it for the music? Go Pro

Also, John Paul Jones is cool with RB and music games.......

...Uhhhh, no. Did you not think it'd be directed at Axl and Slash since he was replying to someone who name-dropped GnR?
