now was the legal problem with Derpy as a name or is it because it could be offensive
because Hasbro does not use the name Derpy Hooves because it is offensive so it seems weird for a non official fan name to stop a song from getting released

True there is part of it that has a similar sound as Hey There Delilah, but it's not actually a direct cover of that song. Just had some influence on the one part.
An example being part of this song from Poni1Kenobi
It sounds similar to a Blink 182 song. But "similar" is all it is. If I'm not mistaken, he just got some influence on that song from Blink 182
Join the Herd is a 100% cover of You're Gonna Go Far Kid by The Offspring. The audio in it (aside from the vocals) is actually FROM the original song.
I believe it was "legal problems" with the name. Don't think that would be taken as offensive since this is a rated T game, compared to the actual show that is targeted towards little kids.

Damn, that really blows. That was the one song I was actually excited for. I really wish that HMX was a little more lenient towards these songs. Yes, I know they're trying to protect themselves legally but I honestly don't think that Hasbro or any other party associated with MLP would be crazy enough (or care enough about a two year old game) to take any legal action because a song contains lyrics mentions their characters.
Technically, Derpy Hooves is an official name because even after that episode, and the whole incident with the idiots and trolls, they still use Derpy Hooves name on her toy. So I guess Derpy Hooves can still be official and still being used.
Also, Derpy Hooves was NEVER offensive... Changing her WAS EXTREMELY offensive.
Trust me, we feel the same way.
Actually that isn't the case. The fans gave that background pony the name "Derpy Hooves" and the only instance when she was called "Derpy" in the show was in that episode that ended up being modified to remove the line where they call her by that name.
There aren't any toys that say "Derpy Hooves" on them. They never have a name on them. The Hot Topic Derpy Hooves toys says "I love [picture of her face]" in place of where the name should go. And even the trading card of her doesn't mention her name.

Even one of the shows writters said using her name as Derpy was a nod to the fans when her name was orginally gonna be "Ditzy"

The Hot Topic box doesn't have "Derpy" pre-printed anywhere, but "Derpy" is on the box's UPC sticker. Also, all of Mighty Fine's / We Love Fine's MLP t-shirts are fully licensed, including all of their Derpy shirts.
Whether Hasbro originally came up with the name or not, the character belongs to them, and they have officially sanctioned use of the name, and even used it once themselves. I imagine that is enough to make Harmonix's lawyers nervous. I don't blame them, even if does make the situation kinda sucky.

It's all right. Everything will work out fine.

Well I know that the We Love Fine t-shirts and such are officially licensed. They would NEED to be since they are using the actual character's IMAGE on the products.
Being "derpy" means "Clumsy or uncoordinated; prone to cause accidents likely due to some, often humourous, mental lapse." I understand that Harmonix just wants to be safe about it but I guess I just wish they would be a little more lenient about it.
EDIT: Bah, guess it's hour fault anyway since we essentially set ourselves up for disappointment by not getting the 100% "This would be fine" before announcing it way back then. Luckily we changed how the group goes about announcing things so this doesn't happen again in the future

"Rarity" is a pretty generic word too, but put it together with ponies and you get a context specific enough to make the lawyers salivate.
Like I said, it sucks, but them's the breaks.
