    "Cult of Personality" vs "Madagascar"

Let me preface this by saying it is not a complaint, only curiosity.

It occurred to me while playing "Cult of Personality" that they had no problem including the spoken speech parts in that song, but for some reason had not used the same in GnR's "Madagascar".

Anyone know why one was able to allow it, but the other didn't?

i don't know anything about Madagascar or the spoken word parts in that song. but as far as CoP is concerned, the audio clips are all public domain, so there wouldn't be any licensing/copyright/trademark/etc issues with using them. if the Madagascar spoken word parts aren't public domain, then maybe rights issues are responsible.

The "I Have a Dream" speech is under copyright by the King estate, so that's probably the reason.

Ted, Just Admit It has part of a real speech segment from Ted Bundy. I'm not even sure what kind of licensing serial killer quotes entail. Also Madagascar has several different people's quotes, getting the license from each of them would have been hell, not to mention if they could only get one it'd make it choppy and lose the impact.

As an aside, I love how the guy who wrote "One in a Million" sampled MLK, Jr. That's balls right there.

Depends on the context, if it's from court proceedings it may be a matter of public record. If it was from a TV program (60 Minutes or something) it may fall to the network responsible for the show. Sampling is crazy and very case-by-case.

I understand licensing all of those clips would be hard, but man, not having that part really takes away from the song.
