I wouldn't go as far as to say Al was nice, but the probation was extremely controversial even in its day. What he was doing can be argued as going around government intrusion.
On the other hand, even if booze had been legal he still would have been killing people over gambling, prostitution, and eventually narcotics.

Tubbs has a new home
It's hard to think of stuff.
"Pretty Boy" Floyd probably would have shot a person for using that nickname in his presence. Charles Floyd was known to be one of the meanest gangster era outlaws and quick on the trigger. The nickname was given to him by the press but not because he was good looking. Calling a person a "pretty boy" was meant to show that they were vain and cared more about their looks than anything else. Floyd hated that the press labeled him that way. (Even if it was probably true)
Mickey Cohen had an obsessive-compulsive tendency to wash his hands, which saved his life on at least one occasion when a hit squad gunned down everybody in a store he was in, except for Mickey, who had just gone off to wash his hands yet again.
Cohen was a pretty lucky SOB anyway. He survived a lot of attempts on his life through sheer luck.
"Baby Face" Nelson killed more FBI agents than any other American criminal. (At least 3) Nelson passionately hated law enforcement and would go out of his way to fight them. On one occasion during a bank robbery, he opened fire without warning on an officer a block away. Laughing he later told his associates (upset by the fact Nelson had turned a controlled situation into a shootout) he did it just because, "I hate cops".
Nelson would eventually be killed in a similar incident. While driving with his wife and an associate, he saw two FBI agents driving the other way. Nelson turned his car around and began chasing the agents. More agents became involved. (Picture a chase with an FBI car, Nelson's car, and another FBI car) Nelson shot it out with the pursing agents, killing both of them but being killed in the process.
