Voice Chat with guest fixed?

I noticed something tonight while playing online. I saw someone jump onto a game with me, and they had a second player playing drums on their screen BUT I could hear them over Xbox live. Was this fixed with the recent patch?

i think that this is the case, i was playin with 3 other ppl that appeared as name, name(1), name(2)...obviously meaning there were two guests...i was like man this sucks i can't talk to em, but i could hear em...all THREE of them, looks like they fixed that glitch.
