I know there was a massive legal blow-up between Morrissey and Marr on one side and Mike Joyce on the other over royalty payments (that the latter pair won). A quick perusal of Wikipedia seems to say that composer royalties weren't in question, so it would seem to me that Morrissey/Marr are still the rights holders to the songs, so getting them to agree to release the songs to the game would be all that would be required. Getting that to happen is another story...![]()

Yeah, "The Smiths".
But, Morrissey & Marr are friends, and they both oversaw the remastering of the songs used on "The Sound Of The Smiths" greatest hits compilation and (according to rumor ONLY) are planning on remastering the original Smiths albums and touring together (not as "The Smiths")

Here is a video from 2004 of Morrissey performing "There Is A Light That Never Goes Out":

So, he would have to have some sort of right to the song in order to perform it in public, right?

If Singstar can have The Smiths, so can Rock Band!

Apparently, this version of the game has a master track of This Charming Man. At least Morrissey/Marr and/or The Smiths' record label is willing to give songs to video games, so there's still a chance to see them in RB.
