This week we challenge you to show us the proper attitude for playing a specific Rock Band song. And we're jumping right in at the deep end: The song is "Down With the Sickness." We dare you to show us—within the bounds of decency of course—the proper look and attitude for playing this lilting number. Crank it up and go wild. We take no responsibility for any actions that get you arrested, injured, or grounded for a week.

The winner will receive a coveted, exclusive, limited edition Rock Band icons t-shirt unavailable to the public!

Official Rules "RockBand.com Weekly Photo Contest" Sponsored by MTV Networks, a division of Viacom International Inc. 1. NO PURCHASE NECESSARY TO ENTER OR WIN A PRIZE. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED OR RESTRICTED BY LAW. 2. Entry Period: "RockBand.com Weekly Photo Contest" (the "Contest") commences at 12:00:01 AM (ET) on Tuesdays and ends at 11:59:59 PM (ET) on Sundays (the "Weekly Contest Period") commencing October 21, 2008 and ending December 29, 2008 (the "Contest Period"). Entries must be received by 11:59:59 PM (ET) on the Sunday before each Monday for each Weekly Contest (as hereinafter defined). 3. Contest Overview: This Contest is made up of individual weekly contests based on the period stated in Paragraph 2 (the "Weekly Contests") that will each take place during the Contest Period. One (1) winner (the "Weekly Winner") will be selected on Mondays each week during the Contest Period from among all the Eligible Entries (as hereinafter defined) received during each Weekly Contest Period prior to such Monday. Limit one (1) prize per individual during the Contest Period. Odds of winning depend on the total number of eligible entries received for each contest. Grand Prizes (as hereinafter defined) vary, including, but not limited to, Rock Band merchandise, MTVN (as hereinafter defined) Merchandise and/or artist related merchandise. 4. Eligibility: This Contest is open to legal residents of the 50 United States and District of Columbia. Entrants must be at least 14 years of age or older at time of entry. Entrants who have not yet reached the age of majority in the jurisdiction in which they reside will need to obtain permission from their parents/legal guardians in order to enter be declared a Weekly Winner. Employees and their immediate families (i.e., parents, spouse, children, siblings, grandparents, step parents, step children and step siblings) of MTV Networks, a division of Viacom International, Inc. ("MTVN"), and each of its respective affiliated companies, sponsors, subsidiaries, advertising agencies, third party fulfillment agencies, agents, employees, officers, directors, successors and assigns (collectively, with MTVN, the "Contest Entities") are not eligible to enter Contest. By participating in this Contest, entrants agree to: (a) be bound by these Official Rules and by the interpretations of these Official Rules by MTVN, and by the decisions of MTVN, which are final in all matters relating to the Contest; (b) release and hold harmless Contest Entities against any and all claims, injury or damage arising out of or relating to participation in this Contest and/or use or misuse or redemption of a Grand; and (c) acknowledge compliance with these Official Rules. 5. To Enter: Entrant must (a) visit http://www.rockband.com/zine, a website owned and controlled by MTVN (the "Website"), at any time during the Contest Period; (b) read the judging criteria provided for that week's contest; and (c) email to zinecontest@rockband.com (i) his/her full name, email address and registered rockband.com profile name and (ii) one (1) photo in JPEG format no larger than one (1) MB depicting what that week's judging criteria stipulated (collectively, the "Submission Material" or "Submission Materials"). Any Submission Material that fails to meet MTVN's specifications may be disqualified. The Submission Material must be comprised only of original elements created by Entrant and may not contain elements which are/have been created, developed, copyrighted, trademarked and/or patented by third parties or which are owned or subject to proprietary or licensing rights of or by an entity other than Entrant personally and in their individual capacity. Any Submission Materials that do not meet each of the requirements stated herein will not be accepted or will otherwise be disqualified. MTVN may require additional copies and/or originals of the Submission Material. In the event of a dispute over who submitted a winning online entry, the authorized subscriber of the e-mail account used to participate in the Contest at the actual time of entry will be deemed to be the entrant. The authorized account subscriber is defined as the natural person who is assigned an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, education, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. All entries become the property of MTVN and will not be acknowledged or returned. Each Entrant hereby grants and agrees to grant to MTVN and to each of the other Contest Entities the right to exhibit, webcast, podcast, broadcast, copy, reproduce, encode, compress, encrypt, incorporate data into, edit, rebroadcast, transmit, record, publicly perform, display, create derivative works of, distribute and synchronize in time related to visual elements, post, and/or otherwise use and/or exploit Entrant's Submission Material or any parts thereof, in perpetuity, anywhere in the world, in any manner or media now existing or hereinafter devised, including, but not limited to, the right to make any and all uses thereof, or for purposes of advertising or trade without any compensation to Entrant. None of the Contest Entities are under any obligation to use the Submission Materials for any purpose. Entrant agrees: (i) that it has all rights to the contents of Submission Material and all components thereof and that Entrant has obtained all rights, consents and permission, including, but not limited to, those of persons participating in the Submission Material, necessary to grant the rights granted herein (e.g., an Entrant will not have an exclusive recording agreement with a record label or other third party which has not consented to the rights granted herein); (ii) that the Submission Materials do not and will not violate any law, statute, ordinance or regulation; (iii) that the Submission Materials are free and clear of any liens or claims with respect to the use of the Submission Materials in the manner authorized herein and will not give rise to any claims of infringement, invasion of privacy or publicity or claims, or infringe on any rights or interests of any third party, or give rise to any claims for any payment whatsoever, including, but not limited to, claims for re-use fees or residuals; and (iv) that the Submission Materials are not and will not be defamatory, trade libelous, pornographic or obscene. Entries which contain materials that are not the original work of the Entrant, or are illegible or incomplete will be disqualified. Entrants agree that their Submission Materials shall not depict, contain, include or involve any of the following: • Obscenity • Crude, vulgar or offensive pictures, depictions, images, language and/or symbols • Gang signs or symbols • Nudity • Commercial products (e.g., clothing, toys, food) and/or their trademarks, brands, logos or endorsements • License plates, phone numbers, personal addresses – physical or email or otherwise personally identifiable information • Website or web page links • Derogatory characterizations of any ethnic, racial, sexual or religious groups, humiliate other people (publicly or otherwise), any assault or threatening of others • Trespass or the violation of other people's rights or property • Illegal (e.g., discriminatory, harassing) or inappropriate activity, behavior or conduct (e.g., inflicting emotional distress) • Conduct or activities in violation of these Official Rules • Any other content, display, materials and/or images that is or could be considered inappropriate, unsuitable or offensive, as determined by the Co-Branded Partners, in their sole discretion Submission Materials containing content which endorses or condones illegal drug use or alcohol abuse are not allowed. Narcotic addiction and alcohol abuse should only be depicted as self-destructive, anti-social behavior. Submission Materials should not promote, glamorize or show as socially acceptable, the use of illegal drugs or the abuse of legal drugs. Submission Materials containing explicit, graphic or excessive sexual activity are not allowed. When sexual themes are key to the meaning or intent of a Submission Material they must be depicted with consistent regard for commonly accepted standards of taste and propriety. Submission Materials containing gratuitous violence are unacceptable. Violence, if depicted, must be essential to the development of a theme, plot or concept of the entry. Violence may not be used to stimulate the audience or to invite imitation, nor may it be shown or offered as an acceptable solution to problem or conflict. Exceptional care must be taken in instances where women and children are victims of, or are threatened by, acts of violence. Language contained in Submission Materials will be evaluated by the Co-Branded Partners based on content and societal acceptability. In submitting an entry into this Contest, each Entrant agrees to, confirms and represents to MTVN that neither he/she nor anyone else has engaged or taken part in (or induced or encouraged anyone else to do so) in any activity or conduct in connection with this Contest that: (i) may or is likely to harm or create a risk of harm, physical or mental injury, emotional distress, death, disability, disfigurement, or physical or mental illness to any person, other living thing or any property; (ii) may or is likely to create a risk of any other loss or damage to persons, living things or property; (iii) is or may constitute a crime, unlawful or non-consensual activities (e.g., conduct that could lead to criminal prosecution), tortious conduct (e.g., conduct that could lead to civil prosecution) or the violation or infringement of the rights of any other party; or (iv) violates any of the terms or conditions of these Official Rules. MTVN is not obligated to review, consider, use, publish, display or broadcast any Submission Materials submitted with an entry; provided, however, that each Entrant acknowledges that MTVN will rely on such Entrant's agreement and compliance with these Official Rules when Entrant submits or attempts to submit the entry. The determination of MTVN that an Entrant's submission is ineligible shall be final. MTVN reserves the right to reject any Submission Materials that it deems, in its sole discretion, to violate any of the policies of these MTVN's "Standards and Practices Guidelines." MTVN may modify or edit any materials related to a Contest entry or request Entrants to do so, so that such materials meet such guidelines. All entries submitted in accordance with these Official Rules shall be collectively hereinafter referred to as the "Eligible Entries", however, the initial determination that an entry is an Eligible Entry is not final and any such entry may be deemed ineligible in accordance with these Official Rules. Incomplete or inaccurate entries are void. All Submission Materials become the property of MTVN and will not be acknowledged or returned. 6. Winner Judging/Judging Criteria: The official judging panel for the selection of each Weekly Winner will be comprised of representatives from MTVN (the "Judges"). The Submission Materials will be judged on a variety of elements weighted equally and posted on each Monday for that week's Weekly Contest Period during the Contest Period. The Judges reserve the right to conduct interviews with any Entrant. The Judges also reserve the right to extend the Contest Period or not to award some or all of the Grand Prizes if they determine, in their sole discretion, that some or all of the Eligible Entries received did not meet the minimum qualification standards based on the judging criteria specified herein during any Weekly Contest. To the extent permitted by law, the Contest Entities disclaim any liability from, and Entrants (whether or not a Weekly Winner) agree to waive, any claims against the Contest Entities relating to the eligibility, judging or awarding process. The application of the judging criteria shall be in the sole and absolute discretion of the Judges. 7. Weekly Winner Selection/Notification: Each Weekly Winner will be selected on or around each Monday after the previous Weekly Contest Period by MTVN in MTVN's sole discretion, from the Eligible Entries received for each Weekly Contest Period throughout the Contest Period. After each Weekly Contest, the pool of Eligible Entries is cleared out and new entries will be accepted for the next drawing. MTVN will make up to two (2) attempts over the 48 hour period following each Weekly Winner selection to contact the potential Weekly Winner via the email address provided on his/her submission. If a potential Weekly Winner cannot be reached during the 48 hour period in which he/she is emailed, the potential Weekly Winner will be disqualified and an alternate Weekly Winner will be selected from among the remaining applicable Eligible Entries received. 8. Weekly Winner Verification: Each potential Weekly Winner must prove eligibility, including, without limitation, proof of age and residence within three (3) days of being notified as a potential Weekly Winner. In the event of non-compliance by a potential Weekly Winner such potential Weekly Winner shall be disqualified and all privileges otherwise due as a Weekly Winner shall be terminated and an alternative potential Weekly Winner may be chosen from among all of the remaining applicable Eligible Entries received in such Weekly Contest, in MTVN's sole discretion. The Weekly Winner must sign (his/her parent/legal guardian must sign if potential Weekly Winner is not the age of majority in the jurisdiction in which he/she resides) within three (3) days of receipt of such documents ("Deadline") from MTVN: (a) an affidavit of eligibility and release of Contest Entities from any and all liability, loss, claims, demands, and causes of action for personal injury and/or damage, theft, loss, or any other harm suffered in connection with this Contest or the use/misuse or acceptance of any Grand Prize or any portion thereof to be eligible for the Grand Prize; and (b) except where prohibited by law, a promotional release granting Contest Entities the right to use his/her name, voice and likeness for advertising and publicity purposes without additional compensation and (c) any other documentation required by MTVN, including a W2 form and Weekly Winner's social security number for tax purposes (collectively, the "Releases"). Entry into this Contest constitutes agreement to sign such Releases. Weekly Winner also must acknowledge that MTVN has not and will not obtain or provide insurance of any kind relating to the Grand Prize and that Weekly Winner (his/her parent/legal guardian must sign if Weekly Winner is not the age of majority in the jurisdiction in which he/she resides) will be responsible for obtaining and paying for any life, travel, accident, property or other form of insurance relating to the Grand Prize. Weekly Winner must also complete any additional legal documents provided by MTVN (or third party on its behalf, if applicable) with respect to the Grand Prize and return them as instructed within the time frame specified by MTVN or Weekly Winner may forfeit Grand Prize at MTVN's sole discretion. Failure to return all such documents and comply with Deadline, noncompliance with these Official Rules or the return of any prize or prize notification will result in disqualification and selection of an alternate winner. All decisions of MTVN relating to the Contest are final. MTVN expressly reserves the right to delay the announcement of any Weekly Winner for creative or technical reasons or for any other reason MTVN deems necessary. 9. Grand Prizes: There will be one (1) Grand Prize, for each Weekly Contest (collectively, the "Grand Prize"). Grand Prizes vary, including, but not limited to, Rock Band merchandise, MTVN (as hereinafter defined) Merchandise and/or artist related merchandise. MTVN is not responsible if potential Weekly Winner is unable or unavailable to accept prize. The approximate retail value ("ARV") of each Grand Prize is $0.00 to $500.00. The ARV is subject to change based on current market conditions at time of Grand Prize fulfillment. Any difference between the ARV and the actual value, if any, will not be awarded. No other substitution, transfer or cash equivalent permitted. The dates for fulfillment of the Grand Prizes will be on or around ten (10) days following each Weekly Winner selection and such dates are subject to change in MTVN's sole discretion. 10. General Prize Terms: Arrangements for fulfillment of the Grand Prizes will be made by MTVN. All costs and expenses not specifically listed above, including, without limitation, any equipment to be used in connection with the Grand Prize are solely Weekly Winner's responsibility. The value of the Grand Prize may be taxable to Weekly Winner as income. Weekly Winner must supply MTVN with his/her social security numbers for tax purposes. An IRS Form 1099 will be issued in the name of Weekly Winner, or if a minor in the jurisdiction in which he/she resides, in the name of his/her parent or legal guardian, for the actual value of the Grand Prize received. Upon entry into the Contest, each Weekly Winner (as well as all other entrants) is required to comply with any and all applicable federal, state, and local laws, rules, and regulations. All federal, state and local taxes (if any), and any other costs and expenses associated with the Grand Prize not specifically provided for in these Official Rules, are solely the Weekly Winner's responsibility. MTVN shall have no responsibility or obligation to a Weekly Winner or a potential Weekly Winner who is unable or unavailable to accept or utilize the Grand Prize as described herein. No substitution, transfer or cash equivalent of the Grand Prizes or any portion thereof is permitted, except by MTVN, in which case a prize of equal or greater value may be awarded. 11. General Terms: Noncompliance with any of these Official Rules may result in disqualification. ANY VIOLATION OF THESE OFFICIAL RULES BY A WEEKLY WINNER OR ANY BEHAVIOR BY A WEEKLY WINNER THAT WILL BRING SUCH WEEKLY WINNER OR CONTEST ENTITIES INTO DISREPUTE (IN MTVN'S SOLE DISCRETION) WILL RESULT IN SUCH WEEKLY WINNER'S DISQUALIFICATION AS A WEEKLY WINNER OF THE CONTEST AND ALL PRIVILEGES AS A WEEKLY WINNER WILL BE IMMEDIATELY TERMINATED. The Contest Entities assume no responsibility for incorrect or inaccurate entry information whether caused by any of the equipment or programming associated with or utilized in this Contest or by any human error which may occur in the processing of the entries in this Contest. MTVN is not responsible for any typographical or other error in the printing of the offer, administration of the Contest, or in the announcement of the Grand Prize and Weekly Winners. If, for any reason, the Contest is not capable of running as planned, including, without limitation, unauthorized intervention, fraud, or any other causes beyond the control of MTVN which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, MTVN reserves the right in its sole discretion to cancel, terminate, modify or suspend the Contest. Should the Contest be terminated prior to the stated expiration date, the Grand Prize may be awarded to a winner to be selected from among all Eligible Entries received up until and or after (if applicable) the time of modification, cancellation or termination or in a manner that is fair and equitable as determined by MTVN. All interpretations of these Official Rules and decisions by MTVN are final. CAUTION: ANY ATTEMPT BY ANY INDIVIDUAL TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, MTVN RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. OK let me get this straight... In this contest we are limited to "within the bounds of decency". When the song is "Down With The Sickness" and the CD cover is a man's head emerging from fore skin. Lame... For a site called rockband you guys don't seem to get.
